1. Acceptance of these terms
By creating an account, signing in, or otherwise using GoalPlate (the "app", "Service"), you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who we are
GoalPlate is operated by Eric Vicente Zepeda Juarez, operating as GoalPlate (a sole proprietor; not yet incorporated) ("we", "us", "our"). You can reach us at support@goalplate.app.
3. What GoalPlate is
GoalPlate is a mobile app that uses artificial intelligence to:
- Generate recipes based on what you ask for
- Adapt those recipes to fitness, budget, and sustainability goals you set
- Build week-long meal plans from those recipes
- Track your progress against your goals over time
The recipes, coaching tips, calorie estimates, cost estimates, and sustainability scores are produced by large language models (Azure OpenAI). They are best-effort suggestions, not professional advice.
4. Eligibility
- You must be at least 13 years old to use the Service. The app asks for your age at first launch.
- In some EU member states the minimum age for consent to data processing is 16. If you live in such a state and are between 13 and 16, you must have a parent or guardian's permission.
- You must have the legal capacity to enter into a contract in your jurisdiction.
- You must not be barred from receiving the Service under the laws of your country or any country where you use the app.
5. Your account
- You are responsible for maintaining the confidentiality of the account credentials you use to sign in (Apple ID, Google account, Facebook account).
- You are responsible for everything that happens through your account.
- You agree the email address and other identifiers you authenticate with are accurate and yours.
- You may delete your account at any time from Settings → Delete my account. Deletion is immediate and permanent.
6. AI-generated content
All recipes, meal plans, coaching tips, calorie estimates, cost estimates, and sustainability scores produced by GoalPlate are generated by AI models. You acknowledge and agree that:
- AI-generated content may contain errors, including incorrect ingredients, omitted allergens, miscalculated nutrition, or misleading instructions.
- AI-generated content is not professional, medical, nutritional, dietary, or financial advice.
- You will use independent judgment before relying on, cooking, eating, or otherwise acting on anything the AI produces.
7. Allergen and ingredient warning
It is your responsibility to verify the ingredients of any recipe before consuming or serving it.
The AI may incorrectly label a recipe as conforming to a dietary filter you have set (for example, generating a "dairy-free" recipe that actually contains a dairy ingredient). The app will surface a warning when our automated cross-check catches such a conflict, but the cross-check is best-effort and does not catch every case. GoalPlate is not liable for allergic reactions or any other adverse health effect resulting from consuming a recipe generated, suggested, or shared through the Service.
If you have a known severe allergy, do not rely solely on AI-generated recipes.
8. Medical and fitness disclaimer
GoalPlate does not provide medical, nutritional, dietary, or fitness advice.
- Calorie targets, BMR/TDEE estimates, and timeline projections are approximations computed from formulas (Mifflin–St Jeor) that work for typical adults but may be wrong for you, especially if you have a medical condition, are pregnant, are recovering from disordered eating, or take medication that affects metabolism.
- Before starting any diet, fitness program, or significant change to your eating, consult a qualified medical professional or registered dietitian.
- If your daily calorie target falls below the minimum we consider safe (1,200 kcal for biological female, 1,500 kcal for biological male), the app will surface a warning and a link to eating-disorder support resources. This is informational only — it is not treatment.
9. Subscriptions and billing
GoalPlate offers paid subscription tiers ("Starter", "Premium", with "Chef" planned for the future). Pricing and features are described in the in-app Paywall.
- Billing is mediated by Apple App Store or Google Play Store depending on the platform you bought from. Card details, refunds, and tax handling are governed by the respective store's terms.
- Auto-renewal: subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the renewal date. Manage or cancel from your store account, not from inside GoalPlate.
- Refunds are handled by Apple or Google according to their refund policies. We do not process refunds directly.
- Free trials and promotional offers, where available, automatically convert to paid subscriptions unless cancelled before the trial ends.
- Tier downgrades take effect at the end of the current billing period.
- If you delete your account while a subscription is active, the subscription continues until the end of the period you've already paid for; cancel via the store to stop renewal.
10. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, including the generation of content that violates any applicable law
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Scrape, mass-download, or otherwise programmatically harvest content from the Service
- Abuse the AI endpoints (for example, automating prompts at high volume, generating content unrelated to food, or attempting to circumvent quota limits)
- Use the Service to generate, transmit, or store content that is harassing, discriminatory, obscene, or that infringes on someone else's rights
- Interfere with the security or operation of the Service, including by injecting malicious code or attempting unauthorized access
- Impersonate another person or misrepresent your affiliation with us
- Resell, sublicense, or commercially redistribute the Service or its outputs without our written permission
11. Your content
You retain all rights you have in the prompts, recipes, meal plans, and other content you create through GoalPlate ("Your Content"). By making a recipe public (publishing to the community catalogue), you grant us and other users a non-exclusive, worldwide, royalty-free license to display, distribute, and adapt that content for the purpose of operating the Service.
You represent that Your Content does not infringe on any third party's rights and complies with these Terms.
12. Our intellectual property
The GoalPlate name, logo, app design, code, and brand assets are owned by us. Nothing in these Terms transfers any of those rights to you.
The AI models GoalPlate uses are licensed from third parties; their outputs are subject to those third parties' terms in addition to ours.
13. Termination
- You can delete your account at any time via Settings → Delete my account. Deletion is permanent.
- We can suspend or terminate your account or access to the Service at any time, with or without notice, if we have a reasonable belief you have violated these Terms, abused the Service, or used it in a way that creates legal exposure for us or other users.
- Upon termination by either party, sections 6, 7, 8, 12, 14, 15, 16, 17, and 18 of these Terms survive.
14. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF VIRUSES, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SAFE TO RELY ON.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the warranties we exclude are limited to the maximum extent permitted by law.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, GOODWILL, OR ANTICIPATED SAVINGS
- ANY HEALTH EFFECT, ALLERGIC REACTION, OR PHYSICAL HARM ARISING FROM YOUR USE OF AI-GENERATED CONTENT
OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN SUBSCRIPTION FEES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.
Some jurisdictions do not allow these limits; in those jurisdictions, our liability is limited to the maximum extent permitted.
16. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, and reasonable expenses (including attorneys' fees) arising from (a) your breach of these Terms, (b) your misuse of the Service, or (c) Your Content.
17. Dispute resolution
You and we agree to resolve any dispute arising out of or relating to these Terms or the Service through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, seated in Phoenix, Arizona, USA. Arbitration may be conducted remotely (by video or telephone) at the request of either party.
Arbitration will be on an individual basis only — YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR CLASS-WIDE ARBITRATION.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@goalplate.app with the subject line "Arbitration opt-out". If you opt out, disputes between you and us will be resolved in the state or federal courts located in Maricopa County, Arizona (see section 18).
Either party may bring an individual claim in small-claims court in their state or county of residence. Either party may also seek injunctive or equitable relief in court to prevent infringement of intellectual-property rights or unauthorized use of the Service.
This section does not apply where mandatory consumer-protection laws of your jurisdiction (for example EU/EEA or UK) prohibit pre-dispute arbitration agreements with consumers; in those cases section 18 applies.
18. Governing law
These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-law rules. Subject to section 17 (mandatory arbitration), the state and federal courts located in Maricopa County, Arizona have exclusive jurisdiction over any dispute that is not subject to arbitration. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If you live in the EU, UK, or another jurisdiction whose mandatory consumer-protection laws override the law chosen above, those mandatory laws apply to you despite this section.
19. Changes to these Terms
When we change these Terms materially, we will:
- Post the new version at the same URL with an updated "Last updated" date
- Bump the Terms version (current: 1.0)
- Re-prompt you for consent the next time you open the app
For minor edits (typo fixes, clarifications), we update the document without re-prompting. Continued use of the Service after a non-material change means you accept it.
20. Miscellaneous
- Severability — if any part of these Terms is held unenforceable, the rest remains in effect.
- No waiver — our failure to enforce any right is not a waiver of that right.
- Assignment — you may not assign these Terms; we may assign them in connection with a merger, acquisition, or reorganization.
- Entire agreement — these Terms and the Privacy Policy form the entire agreement between you and us regarding the Service and supersede any prior agreements.
- Third-party stores — your use of the Service through Apple App Store or Google Play Store is also subject to those stores' terms, including the Apple Licensed Application End User License Agreement (which we incorporate by reference for the App Store distribution).
